What to Expect
Justice Cohen runs Part 4 as an in-person conference part. Preliminary conferences, compliance conferences, pre-trial and settlement conferences, status conferences, inquests, and hearings are held in Courtroom 413 and, by default, require an appearance. The Part runs its conference calendars on a fixed weekly schedule: preliminary conferences on Tuesdays, compliance conferences on Wednesdays, and settlement and pre-trial conferences on Thursdays. Orders to show cause are returnable Tuesdays at 10 a.m. in Courtroom 413. Motions on the regular calendar are returnable across the week and are handled through NYSCEF and the Motion Support Office in Room 217.
Tips
- Conferences are in person in Courtroom 413. Do not assume a virtual appearance. Plan to send someone physically to 851 Grand Concourse for preliminary, compliance, pre-trial, settlement, and status conferences unless the Part directs otherwise.
- Know the day of the week. Preliminary conferences are Tuesdays, compliance conferences Wednesdays, and settlement and pre-trial conferences Thursdays. Confirm which calendar your matter is on before booking coverage.
- Proposed conference orders can save an appearance. The Part permits counsel to submit a fully executed proposed preliminary or compliance conference order at least 48 hours in advance in lieu of appearing. If all parties agree on the schedule, this is the efficient path.
- Orders to show cause are Tuesdays at 10 a.m. OSCs are returnable in Courtroom 413 and do require an appearance. Calendar accordingly.
- Summary judgment within 120 days of the Note of Issue. Part 4 follows the CPLR default. File dispositive motions within 120 days of the NOI filing.
- Route motion papers through Room 217. Motions and working copies go through NYSCEF and the Motion Support Office in Room 217, not chambers.
