Medical Malpractice Cases
Part 19 handles medical malpractice cases. Judge Gerez will issue a case management order at the preliminary conference outlining discovery deadlines and trial dates.

What to Expect
Judge Gerez is a thoughtful jurist who listens to both sides. She is fair but firm. She will grant reasonable extensions and adjournments if there is good cause, but she expects counsel to be prepared and professional.
Tips
- Be honest about your case. Judge Gerez respects candor. If there is a problem with your case, acknowledge it and propose a solution.
- Expert disclosures are important. Have your experts' CVs and reports ready at the preliminary conference. Late expert disclosures will be questioned.
- Mediation is encouraged. Judge Gerez may suggest mediation. Consider participating; she believes many cases can be resolved without trial.
- Deadlines are strictly enforced. This Part expects discovery deadlines to be adhered to. If there is a delay, the court does not want parties coming back at the next conference saying EBTs were not completed. If an issue arises between conferences, file a letter to the court on NYSCEF rather than waiting.
- Pre-trial orders are taken seriously. Comply with all deadlines in the case management order. Violations will result in sanctions.
- Motions should be well-briefed. Sloppy or incomplete motions will be denied. Take the time to properly brief your motion.
