Motion Practice

Schedule: All motions are heard every Wednesday (except holidays) in-person, in Courtroom 774, with first call at 9:30 AM. Attorneys must be present and ready to proceed.

Virtual Option: The last Wednesday of each month features a virtual motion calendar (effective October 29, 2025). Virtual appearances are permitted ONLY if all parties agree in advance. If parties do not agree, the motion defaults to in-person. To request a virtual appearance, email a signed stipulation to the Part Attorney at least 3 days before the scheduled date. Email must include the index number and case caption.

Calendar Defaults: Under CPLR 3012.1 and Uniform Rule 202.27, the court has discretion to dismiss or enter judgment for failure to appear without notice or to seek an adjournment.

Communications with Chambers

Email Protocol: No phone calls to chambers. All communications must be by email to the court attorney (ncjohnso@nycourts.gov) with copies to all parties and the attorney's own client. Subject Line: Email subject lines must include the index number and case caption. Do NOT copy the judge directly. Non-Compliant Communications: Communications that do not comply with these rules will be disregarded by the court.

E-Filing Requirements

Mandatory NYSCEF: All cases must be e-filed through the New York State Courts Electronic Filing System (NYSCEF). Motions will be adjourned if the case is not e-filed.

No Courtesy Copies Required: Courtesy copies are NOT required. All documents must be text-searchable PDFs with page numbers. Documents must be filed in NYSCEF and not delivered in hard copy unless otherwise directed by the court.

Summary Judgment Practice

Timing: Summary judgment motions must be made within 60 days of filing a Notice of Intent to Move for Summary Judgment.

Statement of Material Facts Required: A Statement of Material Facts is mandatory. Failure to include one can be grounds for denial of the motion.

Expert Affirmations: When filing summary judgment papers, unredacted expert affirmations or affidavits must be emailed to chambers (ncjohnso@nycourts.gov) at the time of NYSCEF filing. This is in addition to the NYSCEF filing itself.

No Sur-Replies: The court will not accept or consider a sur-reply affidavit, affirmation, or letter without prior leave of court. Do not file a sur-reply without requesting and receiving permission first.

Trial Practice

Punctuality: All parties and counsel must be present and ready to proceed by 9:30 AM on the trial date.

Required Documents: Counsel must furnish a Bill of Particulars and marked pleadings per CPLR 4012 at the beginning of trial.

What to Expect

Judge Green has been on the Kings County bench for more than a decade and runs a well-organized courtroom. He expects attorneys to know the case and the rules. If you are appearing for the first time in Part 33, read the Part Rules carefully before you walk in. The court does not tolerate non-compliant communications, and calendar defaults are handled strictly. Come to every appearance prepared to discuss the case status, discovery, and pending motions.

Tips

  • "Read the Part Rules." This is a courtroom where non-compliant communications are disregarded. Know the email protocol: include the index number and caption in the subject line, copy all parties, and do not copy the judge directly. This attention to detail matters.
  • "Virtual motion option." The last Wednesday of each month offers a virtual motion calendar if all parties agree in advance. If you can get all parties' consent and submit a stipulation 3 days before, you save a trip to Brooklyn. But if one party objects, you must appear in person.
  • "Statement of Material Facts is required." On summary judgment motions, you must include a Statement of Material Facts. Failure to include one is grounds for denial. Judge Green enforces this rule consistently.
  • "No sur-replies." The court will not accept or consider a sur-reply affidavit, affirmation, or letter without leave of court. If opposing counsel files one without permission, object. Judge Green does not permit unauthorized sur-replies.
  • "Expert affirmations go to chambers." When filing summary judgment papers, email unredacted expert affirmations to chambers upon filing. This is mandatory and separate from the NYSCEF filing. Do not omit this step.
  • "Know the discovery posture." Judge Green will ask about discovery status, what has been exchanged, and what remains outstanding. Do not show up unprepared or vague about the case. If you are covering for the regular attorney, be thoroughly briefed on discovery, pending motions, and any outstanding issues.
  • "Be punctual." All parties must be present and ready by 9:30 AM. Do not be late. If you are covering a matter and will be representing a party, confirm with the office that you are prepared and that the client and any witnesses will be present.
