What to Expect
Justice Hensley handles compliance conferences at Suffolk County Supreme Court in Riverhead. Expect a bench conference where the judge reviews the status of discovery and addresses any outstanding issues. The court takes an active role in managing discovery timelines and will issue orders directing specific actions by the parties.
Tips
- Know the discovery status cold. The court will ask about outstanding EBTs, document demands, and authorizations. Be prepared to give a clear status report at the bench.
- Supplemental pleadings create new discovery obligations. If your client has served a supplemental Bill of Particulars, expect the defense to request additional authorizations and a further EBT limited to the new claims. Justice Hensley is receptive to these requests if they are reasonable.
- Court orders are prepared by the parties. After the bench conference, the court may direct the parties to prepare a stipulated court order memorializing what was agreed to. Have your counterpart's contact information ready so you can coordinate.
- Cases are marked to certify on the next date. If the court is satisfied with the progress of discovery, the next compliance conference may be marked for certification. Make sure you are in a position to file the Note of Issue by that date.
- Review the order promptly. Court orders are uploaded to e-courts within approximately 24 hours of the conference. Review the order as soon as it is available to confirm all deadlines and directives.
