In-Person Motions, Mondays at 10:00 AM

Under the Part 16 rules, all motions are returnable and heard in person on Mondays at 10:00 AM. Appearances are mandatory for all motions and applications. This is a meaningful difference from the many Queens parts that decide motions on submission. In Part 16, counsel is expected to appear and be prepared to address the motion. Failure to appear on the return date can result in the motion or application being marked off calendar or submitted without opposition.

Consequences of Non-Appearance

If a motion or application is marked off for non-compliance with the Part Rules, a new motion for the original relief may need to be filed in accordance with the Part Rules. Because appearance is mandatory, do not treat a Part 16 return date as a paper-only submission. Someone has to be in the room.

Adjournments

Parties seeking to adjourn a motion should contact the Part at QSCPart16@nycourts.gov at least two business days prior to the calendared date and time. Adjournments are subject to approval by the Judge. On-consent requests submitted early are the safest path.

CSCP3 Compliance Matters

Justice Lanzetta also presides over CSCP3, a central standards compliance part. Compliance conference practice and motion practice run under different expectations, so confirm which calendar your matter sits on before arranging coverage. Discovery compliance conferences and motion return dates are not the same appearance.

NYSCEF Filing

Motion papers should be e-filed through NYSCEF in accordance with the CPLR and the court’s local filing rules. Working copies may be required for substantive or exhibit-heavy motions. Confirm working copy requirements with the Part Clerk when filing.

Part 16 Requires a Body in the Room.

The single most important thing to know about Part 16 is that it is an in-person motion part with mandatory appearances, not a submission part. Attorneys who practice mostly in submission-only parts sometimes assume they can let a motion ride on the papers. In Part 16, that assumption can cost you the motion. If you cannot be there on the Monday 10:00 AM call, send experienced per diem counsel who can.

Practice Tips

  • Monday mornings. The motion calendar is called Monday at 10:00 AM. Plan your week around that fixed call. Security and elevator lines at 88-11 Sutphin can eat 15 to 20 minutes at the morning peak.
  • Confirm the calendar. Part 16 and CSCP3 are different tracks. Make sure you know whether your appearance is a motion return or a compliance conference before you or your per diem walks in.
  • Adjourn early. Requests go to QSCPart16@nycourts.gov at least two business days out, on consent where possible. Same-day requests are disfavored.
  • Courtroom changes. Queens Supreme Court reshuffled multiple Parts in January 2026. Confirm the courtroom with the Part Clerk before arriving if you have not appeared recently.

When to Send Per Diem Counsel

Straightforward adjournments, procedural status updates, and uncontested applications are well suited to experienced per diem coverage. Contested substantive motions, particularly dispositive motions, are better handled by the attorney of record or a fully briefed associate who knows the discovery record.
