This is an appearance part in the strict sense. Every motion is called on its return date, so a firm that files and waits for a decision without sending someone will be marked. Plan on covering the return date or arranging the adjournment in writing before the Friday noon cutoff.
Tips
- Calendar the Friday noon deadline, not the return date. An adjournment or a withdrawal must be emailed to chambers staff by noon on the Friday before the motion is returnable. A request made on the morning of the appearance is late.
- One adjournment on summary judgment. Build the briefing schedule around a single adjournment, because a second request on a summary judgment motion is not granted.
- Do not plan on a sur-reply. Supplemental briefs and sur-replies are not accepted, so the argument has to be complete in the moving and opposing papers.
- Know which part your disclosure motion belongs in. Disclosure motions are heard here only in MMESP-7 cases. A Part 15 disclosure motion goes to the Central Compliance Part.
- Email the proposed order. Proposed orders go to chambers electronically rather than being handed up in the courtroom.
