Discovery and Deadlines
The court issues detailed orders specifying EBT dates, post-EBT demand deadlines (30 days to serve, 30 days to respond), and Note of Issue deadlines.

What to Expect

If you come prepared with proposed dates for outstanding EBTs and a clear picture of where discovery stands, the conference moves quickly and you leave with a detailed order.
Tips
- Come with specific dates. Justice Ramseur will set EBT dates, post-EBT demand deadlines, and response deadlines in the court order. Have your calendar ready and propose dates that work for your client and experts.
- Post-EBT demands are on a 30-day clock. The court typically orders post-EBT demands served within 30 days of each EBT, with responses due within 30 days of receipt. Plan accordingly.
- Outstanding demands get addressed. If there are any outstanding discovery demands, expect the court to order responses within 30 days to the extent not previously provided. Do not come to a conference with unexplained gaps in discovery compliance.
- Note of Issue deadlines are firm. The court sets a specific NOI deadline in the order. Treat it as a hard deadline.
- Dispositive motions window. Summary judgment and other dispositive motions must be filed within 60 days of the Note of Issue. This timeline is set in the court order.
