General

Motion Practice
Motions are heard on Thursdays. All motion papers must be filed electronically through NYSCEF. In an action that does not participate in NYSCEF, papers are filed with the Motion Support Office at 360 Adams Street, Room 227.
Appearances
An in-person appearance is required on all motions. The single exception applies where the parties have resolved the motion on consent and uploaded a proposed order through NYSCEF at least three business days before the return date, and the movant has received confirmation from the Part Clerk that no appearance is necessary. The part rules direct counsel not to call the court to ask whether an appearance is required.
Adjournments
An adjournment is granted only on the consent of all parties, by filing a stipulation through NYSCEF before the return date. Parties may not stipulate to serve answering papers less than two weeks before the return date. The part rules direct counsel not to call or email the court for an adjournment.

What to Expect
Part 9 is one of the strictest appearance parts in Kings County, and the published rules say so in capital letters. Somebody has to stand up on the motion, the adjournment has to be papered in advance, and the court does not want to hear from counsel by phone or email on either question. Treat the return date as a firm court date and staff it.
Tips
- Assume you are appearing. An in-person appearance is required on every motion. The only way out is a consent resolution with the proposed order uploaded through NYSCEF three business days ahead, plus confirmation from the Part Clerk. Without that confirmation in hand, send someone.
- Do not call to ask. The rules expressly tell counsel not to call the court to find out whether an appearance is required, and not to call or email for an adjournment. A phone call is not a substitute for a filed stipulation.
- Adjourn on paper, not on the record. The stipulation must carry the consent of all parties and must be filed through NYSCEF before the return date. Counsel also cannot stipulate to serve answering papers less than two weeks before that date, so a late briefing agreement will not hold.
- Do not bring a discovery dispute here. Discovery is handled in the Discovery Part. A motion that belongs in PC Intake, the Central Compliance Part, or the Final Conference Part is in the wrong room.
- Thursdays fill up. Motions are heard on a single day each week, so build travel and coverage around a Thursday calendar call.
- Brief your per diem on the posture. Oral argument is expected, not waived, and the covering attorney should know the papers well enough to argue them.
