What to Expect
Judge Silber is thorough and detail-oriented. She reads the papers carefully before the calendar call, and her questions will reflect that. If there is a weakness in your motion papers, expect it to come up. This is a judge who does her homework, and she expects the same from the attorneys appearing before her.
Tips
- Your papers need to be right. Judge Silber reads everything. Sloppy papers, inconsistencies in your affidavits, or missing exhibits will be noticed and will work against you.
- Be ready to answer specific questions. When the judge asks about a particular paragraph in your brief or a specific exhibit, you need to be able to respond without fumbling through the file.
- Two-call system. Part 9 uses a first call and second call. If the opposition does not appear at the second call, the motion will be marked fully submitted and the court will issue a written order. Be there for both calls if your motion is contested.
- Discovery conferences are thorough. If you are appearing on a compliance conference, know exactly where discovery stands. Be specific about dates, outstanding items, and proposed deadlines.
- Brief your per diem well. Given the level of detail Judge Silber expects, make sure anyone covering for you has a complete picture of the case.
