Before You Send a Covering Attorney
On a motion in this part, do not send anyone. The published rules put the Part 17 motion calendars on submission and state that there is no physical appearance on any motion calendar. A covering attorney who travels to the courthouse for a Wednesday motion return date has nothing to appear on.
Conferences and foreclosure matters are a different question and are handled separately. Those may be in person or by Microsoft Teams, so the appearance type has to be read off the notice for that specific date rather than assumed from the part.

The Motion Calendars Are Submission Only
The published rules state it in terms that leave nothing open: “The calendars in Part 17 are submission only. There shall be no oral argument of any motion, petition or application.” Papers are filed, the motion is submitted, and the part decides it on the record that was filed.
No Physical Appearance on Any Motion Calendar
There is no physical appearance on any motion calendar in this part. Counsel does not go to the courthouse for a motion return date, and neither does a covering attorney.
Motions Are Returnable Wednesdays at 10:00 a.m.
Motions in Part 17 are returnable on Wednesdays at 10:00 a.m. The return date is the date the motion is submitted, not a date anyone appears on.
The Sole Exception
The published rules carry one exception to the no-oral-argument rule, and it is narrow: a preliminary injunction with a temporary restraining order. Nothing else on the motion calendar is argued.
Conferences and Foreclosure Matters Are Different
The submission-only rule governs the motion calendars. It does not govern conferences, and it does not govern foreclosure matters. Conferences and foreclosure matters are held in person or by Microsoft Teams. Those dates can require an actual appearance, in the courthouse or on a Teams link, so the format has to be confirmed for each one.
Adjournments
An adjournment is requested by email 48 hours ahead of the date, or by stipulation or letter that is both e-filed and emailed. Filing alone does not do it, and emailing alone does not do it. The stipulation or letter goes to both places.
No Telephone Inquiries to Chambers
Chambers does not take telephone inquiries. A call placed to chambers to chase a decision, confirm a date, or ask about an adjournment is contrary to the published rules, and it is a conspicuous way for a covering attorney to make a routine matter worse. Adjournment requests and correspondence go through the written channels the rules identify.
Always verify the current Part Rules with the part before any appearance. Rules and assignments change, and the published rules on nycourts.gov are the controlling source.

Tips
- Keep the motion calendar and the conference calendar apart. A Wednesday motion return date in this part takes no appearance from anyone. A conference or a foreclosure matter can be an in-person date or a Microsoft Teams date, and it is read off the notice for that date.
- Do not book coverage on a Part 17 motion. There is no oral argument and no physical appearance, so a covering attorney sent to a motion return date has nothing to do there.
- Move on an adjournment two days out. The email request runs 48 hours ahead of the date. A stipulation or a letter has to be e-filed and emailed, both, so build in the time to do both.
- Do not telephone chambers. The rules say no telephone inquiries, and a call is the fastest way to turn a routine adjournment request into a problem.
- The one argued application is a preliminary injunction with a temporary restraining order. That is the only thing on the calendar that draws argument, and it should be staffed accordingly.
Field Note from 2026
A conference our office was asked to cover in this part was calendared for 9:30 a.m. rather than the afternoon, and the part sent a correction email of its own initiative.
The practical lesson is about where the time comes from. Confirm the conference time against the part's own notice rather than against the assignment email. This is one dated observation from one matter, not a published rule and not a prediction of what happens on any other date.
