In-Person Appearances Are Required on Every Motion, and Have Been Since July 1, 2025
The rule carries its own effective date, and the date is the point:
“Beginning Tuesday, July 1, 2025, IN-PERSON APPEARANCES ARE REQUIRED FOR ALL MOTIONS. Failure to appear may result in the motion being marked off or opposition not being considered.”
An attorney working from an older habit, or from a secondhand account of this part, will get this wrong and will treat a motion here as something that can be left on submission. The published rule is the opposite. Every motion requires an in-person appearance, and the stated consequence of a failure to appear is that the motion may be marked off or the opposition may not be considered.

Motions in Part 28 are returnable on Tuesdays at 10:00 a.m.
Papers E-Filed After the Calendar Call Are Not Considered
Papers e-filed after the calendar call are not considered. The calendar call is the cutoff, so opposition and reply papers have to be e-filed before the call rather than later in the day the motion is heard.
Oral Argument Only by Court Order After Full Submission
Apart from the required appearance on the return date, oral argument happens only by order of the court after full submission. Counsel appears because the part rule requires the appearance, not because argument is scheduled.
Adjournments. The First One Is Granted Without an Appearance
The adjournment rule is unusually favorable and worth reading closely. The first adjournment is granted without an appearance, for thirty days, on a fully executed stipulation filed by 5:00 p.m. the Friday before. A later adjournment requires an appearance.

Before You Send a Covering Attorney
Part 28 is not a submission part, and it has not been one since July 1, 2025. Somebody has to stand up on every motion, on a Tuesday at 10:00 a.m., in Courtroom 122. The published consequence of an empty chair is that the motion may be marked off or the opposition may not be considered, which means a missed appearance can cost the papers rather than the date. If the motion is being adjourned, use the first adjournment: a fully executed stipulation filed by 5:00 p.m. the Friday before carries thirty days and requires nobody in the courtroom. After that first adjournment, somebody has to appear.
