Motions Are Not Taken on Submission
The Part 99 rules state that motions are not taken on submission unless approved by the Court. Approval is the exception, and it has to come from the Court. An attorney who treats a Kings County motion date as a submission date, and therefore sends nobody, has no one in the courtroom when the case is called.
Non-Discovery Motions Only
Part 99 hears non-discovery motions only. Confirm what is actually on before the date, because a discovery motion does not belong to this Part.
In-Person Appearances
An in-person appearance is required on all Part 99 motions, conferences, and hearings.
Calendar Call
The calendar is called at 9:30 a.m., with a second and final call at 10:30 a.m. The second call is the last one.
Adjournments
The first adjournment is granted liberally on a stipulation signed by all counsel, no later than the Friday before.

Before You Send a Covering Attorney
This is the exposure in Part 99. Motions are not taken on submission unless the Court approves, so an attorney who assumes a submission part and does not appear has nobody at the call. The calendar is called at 9:30 a.m. and called a second and final time at 10:30 a.m. Whoever covers the date needs to be in Courtroom 574 for the first call and no later than the second, and needs to be able to speak to the motion.

What to Expect
Part 99 is a non-discovery motion part that sits in person and runs off a 9:30 a.m. calendar call with a second and final call an hour later. The submission rule is the item that catches out-of-part counsel, because the default assumption in a motion part is the opposite of the rule here.
Tips
- Do not plan on a submission. Unless the Court has approved the motion for submission, someone appears. Treat the motion date as an appearance date until the Court says otherwise.
- Build the morning around 10:30 a.m. The second call is final, so a covering attorney who is still in the security line at 10:30 has missed the case.
- Lock an adjournment down by the Friday before. The first adjournment is granted liberally, but it runs on a stipulation signed by all counsel, and the deadline is the Friday before the date.
- Check what is actually on. Part 99 hears non-discovery motions only, so confirm the motion belongs here before anyone travels to Courtroom 574.
Field Note from September 2026
This is an account of one appearance on one date. It is not a rule of the Part.
On September 9, 2026, at a settlement conference in 170 Marcy Avenue LLC v. 168 Marcy LLC (Index No. 511617/2026), the Court declined to enter a discovery order over defense opposition and adjourned the matter. The Court directed that a demand letter setting out why the plaintiff's damages exceed the jurisdictional threshold be sent to the Part, and required the client to attend the next conference, which was set for December 9, 2026 at 2:30 p.m.
