Critical Rule: Proposed Orders

Judge Stein requires that for all motions, counsel must submit a proposed order. Proposed orders must be uploaded to NYSCEF prior to the calendar call. Any papers intended to be "So Ordered" (including stipulations) must also be emailed to the appropriate Part email: KSCCVPART17@nycourts.gov for IAS Part 17 matters, or KSCCVDJMP@nycourts.gov for DJMP matters.

Orders must include a full caption naming all parties. For no-fault insurance declaratory judgments, your Proposed Judgment must contain the accident date, policy number, and claim number.

DJMP Calendar (Default Judgment Motion Part)

Tuesdays at 10:00 AM in Courtroom 423 at 360 Adams Street. There is no second call. Failure to appear at 10:00 AM will result in the immediate denial of the motion or a default judgment against the non-appearing party.

IAS Part 17 Calendar (General Inventory)

Every other Tuesday at 11:00 AM. There is no second call. Counsel must be ready for oral argument and possess intimate knowledge of the underlying case.

Exhibit and E-Filing Protocols

Judge Stein does not allow "incorporation by reference" for electronic filings. You may not refer to a document by its prior NYSCEF docket number. Every document relied upon in a motion must be re-attached as a new exhibit.

Subpoenas must be approved and stamped by the Subpoenaed Records Room (6th Floor) before being left in the drop box outside Courtroom 423.

For non-NYSCEF actions, hard copies must be delivered to Room 227 (Motion Support) at least 10 business days before the argument date.

Adjournments

Adjournment requests must be emailed to the appropriate Part email by 10:00 AM on the business day prior to the return date. Stipulations filed on NYSCEF alone are insufficient. You must receive explicit email confirmation from the Part.

What to Expect

Judge Stein handles both IAS Part 17 matters and the Default Judgment Motion Part. Both calendars operate with no second call, meaning if you are not there when your case is called, you lose. The DJMP calendar can be heavy with paper submissions. If you are appearing on a default judgment motion, make sure your papers are airtight and your proposed order is already uploaded and emailed before you walk in.

Tips

  • No second call means no second chance. Be in Courtroom 423 before 10:00 AM for DJMP or before 11:00 AM for IAS Part 17. If you miss the call, the motion gets denied or you take a default. There is no grace period.
  • Proposed orders are mandatory. Upload to NYSCEF and email to the Part before the calendar call. If you show up without a proposed order already submitted, you are not prepared for this courtroom.
  • No incorporation by reference. Every exhibit you rely on must be physically attached to the current motion. Referring to a prior NYSCEF docket number is not permitted. Re-attach everything.
  • Expect a reserved decision on defaults. On default judgment applications, Judge Stein typically reserves decision following oral argument rather than ruling from the bench. Expect a written decision within 30 to 60 days, filed through NYSCEF.
  • Adjournment confirmation is required. Filing a stipulation on NYSCEF alone does not adjourn your matter. You must email the Part and receive confirmation back. If you do not have that confirmation, assume you are appearing.
  • IAS matters run every other Tuesday. Part 17 IAS conferences are separate from the DJMP calendar. Come prepared with the full discovery posture and be ready for oral argument.
