What to Expect
Judge Wade expects attorneys to be ready for substantive oral argument on motion day. This is not a part where you can show up, hand in papers, and walk out. If you have a motion on the calendar, be prepared to discuss it. The first call moves through matters that are on consent or uncontested, and the second call is for argued motions.
Tips
- Oral argument is real here. Do not send someone who cannot argue the motion. Judge Wade asks questions and expects responsive answers on the law.
- First call is for consent matters. If your matter is on consent or a simple adjournment, get there for the 9:45 first call and you can be out quickly.
- Second call is where it gets substantive. Contested motions go to the 10:30 second call. Prepare accordingly.
- Know the opposition papers. Judge Wade will reference specific arguments from the opposition. Read their papers carefully before you walk in.
- Judge may not always be available. We have experienced calendar days in Part 84 where Judge Wade was not in and all matters were adjourned. If you are traveling from outside Kings County, consider confirming with the Part Clerk the morning of your appearance that the calendar is proceeding.
