General
Part 83 is an IAS part at 360 Adams Street, Brooklyn, NY 11201, in Courtroom Room 738. Personal appearances are required for the Part 83 calendar. Conferences, hearings, and oral argument on motions are conducted in court, virtually, or telephonically as the court directs, and in-person appearances are specified in the notices sent to the parties.
Motion Practice
Motion days are every other Wednesday, and on non-motion days as determined by the court. Whether the appearance is virtual or in person, the first calendar call is at 9:45 AM and the second call is at 10:30 AM. A failure to appear may result in the motion being marked off. Virtual oral argument is conducted on Microsoft Teams, and a courtesy notice with the part rules and the hyperlinks for motion days is posted on NYSCEF and eCourts. A separate hyperlink is provided for non-motion day appearances. All motion papers must be filed electronically through NYSCEF.

Preliminary, compliance, and status conferences are scheduled through the Part Clerk. Parties should be prepared to address discovery deadlines, deposition scheduling, and any pending motions.

What to Expect

Tips
- Have your discovery status ready. At conferences, Judge Joseph will want a clear picture of where discovery stands. Know what has been exchanged, what depositions have been completed, and what remains.
- Consent adjournments. If both sides are consenting, have the stipulation drafted and signed before you get to the courtroom. This saves time for everyone.
- Be on time. The calendar starts when it starts. Late arrivals will not be accommodated on the first call.
