General
Justice O'Neale handles IAS Part 23 as well as City Parts 7 and 22 in Courtroom 456 at 360 Adams Street. The published rules name Law Clerk Helen Ding, Assistant Law Clerk Adam Fane, and Part Clerk Tiffany Sellers. The part prohibits ex parte communication and will not accept unsolicited documents.
Motion Practice and Appearances
All motions must be e-filed through NYSCEF and must comply with CPLR 2214 as to notice, supporting papers, and timing. All motions and orders to show cause require an in-person appearance unless the court directs otherwise, and oral argument is required. City Parts 7 and 22 calendars are heard on alternate Wednesdays, with the 10:00 AM call for numbers and last names A through M and the 11:00 AM call for N through Z. There is no default calendar call, and a failure to appear can result in a default or a denial of the motion under 22 NYCRR 202.27. Working copies are not required except for affidavits of service on orders to show cause. Video exhibits are submitted on a USB drive with a Notice of Hard Copy Exhibit Filing. Sur-replies are not permitted absent good cause.
Resolving a Motion Before the Return Date
If the parties resolve a motion by consent, e-file a proposed order signed by all parties at least three business days before the scheduled appearance. A party withdrawing a motion files a notice of withdrawal on NYSCEF at least three business days before the appearance.
Adjournments
The part grants no adjournments by email or telephone. A first adjournment may be taken on consent or on application, for no more than six weeks, by a stipulation filed at least three business days before the return date that sets a briefing schedule, with opposition due two weeks before the new date and reply due one week before. Any further or contested adjournment must be sought in person on the return date.
Discovery, Orders to Show Cause, and Stipulations
Discovery disputes are handled in the City Discovery Part at (347) 401-9264 or KSCCVCDCP@nycourts.gov. Depositions are governed by 22 NYCRR Part 221, and the court does not rule on objections during a deposition. Orders to show cause are handled by Part 72, the Ex-Parte Part; opposition to an order to show cause is due at least one day before the return date, and no reply is permitted absent leave. Summary judgment timing follows the Kings County Uniform Civil Term Rules. The court does not so-order stipulations of settlement or discontinuance.

What to Expect
Justice O'Neale handles both IAS and City Part cases. The courtroom is organized and the judge expects attorneys to come prepared. The calendar is called in person, there is no default calendar call, adjournments are not handed out freely, and a no-show carries real consequences under 22 NYCRR 202.27, including a default or a denial of the motion. If you are on a City Part case, be aware that cases involving the City of New York have their own pacing. The Law Department operates on its own schedule, and conferences in City Parts can reflect that.
Tips
- Do not skip the appearance. This part calls its calendar and expects counsel present. If you cannot resolve the matter by a timely consent order, appear. A failure to appear risks dismissal or denial.
- Consent orders go in early. If a motion is resolving on consent, e-file the proposed order signed by all parties at least three business days before the scheduled appearance. Miss that window and you should plan to appear.
- Never ask for an adjournment by email or telephone. The published rules refuse both. A first adjournment runs on a stipulation filed at least three business days before the return date, and it must carry a briefing schedule.
- Confirm your calendar in advance. City Parts 7 and 22 are heard on alternate Wednesdays and have separate calendars from IAS Part 23. Make sure you know which one your case is on.
- City Part cases move differently. If the City of New York is a party, expect the Corporation Counsel to have its own procedures for settlement discussions and discovery. Plan accordingly.
- Come prepared on discovery. For IAS matters, Judge O'Neale will want to know the discovery status in detail. Have a clear picture of what has been exchanged and what is outstanding.
- Per diem coverage is standard. For routine conferences and compliance matters, brief your covering attorney on the discovery posture and any consent stipulations.
