Motion Practice

Summary Judgment: 60 days after Notice of Issue (NOI) per Kings County Uniform Rules.

Orders to Show Cause: Must comply with 22 NYCRR 202.7, 202.8-d, and 202.8-e. Orders to Show Cause are only appropriate for genuine urgency (such as temporary restraining order applications), stays, or statutory mandates requiring immediate court action.

Proof of Service: Must be filed on NYSCEF before the return date. For non-NYSCEF cases, proof of service must be either emailed to ksccvpart92@nycourts.gov or presented in person on the return date.

Communication Protocol

All inquiries about adjournments and scheduling must be directed to the Part Clerk at 347-401-9233 or ksccvpart92@nycourts.gov. Opposing counsel must be copied on all emails. Ex parte communications are strictly prohibited. Do not call chambers directly to request adjournments; use the Part Clerk.

Part 92 uses Microsoft Teams for certain appearances. Log on at the start time, check in with the clerk, listen for your case name, and wait in the queue. If your matter is adjourned to a new virtual date, reuse the same Teams link from the original notice. No new notice will be sent.

Filing Requirements

NYSCEF is mandatory for all motions and papers. Courtesy copies are not required (Kings County uniform rule).
