General
Judge Sweeney sits in Courtroom 761 at 360 Adams Street and holds three assignments: IAS Part 73, Commercial Part 3, and the Special Election Part. All motion calendar calls and trials require an in-person appearance.
Motion Practice
Motions are heard on Mondays, and oral argument is required on every unresolved motion. Counsel must know the motion and the case and must be ready to argue on the return date. Since June 16, 2025, the part has staggered oral argument by caption: cases beginning with a number or with the letters A through P are called at 10:00 AM, cases beginning with the letters Q through Z are called at 11:30 AM, and all Commercial Part 3 cases are called at 2:15 PM. There is no second call. The court may decide a motion on default where a party fails to file papers on time and appear, fails to submit a consent order, or fails to obtain an adjournment under these rules. Counsel may bring a hard copy of the papers to argument, but must not send copies to chambers in e-filed cases.
Adjournments
The parties may stipulate to adjourn a motion that is first time on or second time on, and the stipulation must be signed by all parties and filed no later than three business days before the scheduled first appearance. Opposition papers are due two weeks before the return date set by the court, and reply papers are due at least one week before it. The court may change the return date on receipt of the stipulation, so check UCS eCourts. After the first adjournment, the parties must appear in person on the return date to seek the court's consent to any further adjournment.
Resolving a Motion Without Appearing
The parties may resolve a motion by stipulation or consent order and e-file it, together with a proposed order, no later than three business days before the scheduled appearance. Fully executed stipulations and proposed orders go through NYSCEF, and in a case that does not participate in NYSCEF they are emailed to KSCCVPart73@nycourts.gov.

What to Expect
Judge Sweeney is one of the more experienced jurists on the Kings County civil bench. He has seen it all. The courtroom runs efficiently, and the judge does not waste time on matters that are not ready. If you have a contested motion, be prepared to make your argument concisely and respond to questions on the law.
Tips
- Check your caption before you calendar the day. Argument time depends on the first character of the case name. A number or A through P is called at 10:00 AM, Q through Z at 11:30 AM, and Commercial Part 3 at 2:15 PM. There is no second call, so an attorney who shows up for the wrong session has missed the case.
- Be concise. Judge Sweeney appreciates attorneys who get to the point. If you can make your argument in five minutes, do not take fifteen.
- Know the law. On contested motions, Judge Sweeney will engage on the legal issues. Be ready to cite authority and respond to the opposition papers.
- Commercial contract cases are common. Part 73 handles a range of commercial contract disputes, including merchant cash advance and usury cases. If your motion involves receivable purchase agreements, be prepared to argue the loan-versus-purchase distinction and the specific factors the court will examine.
- Experience matters here. This is a judge who will notice the difference between an attorney who knows the case and one who is reading from a script. Brief your per diem thoroughly.
- Special Election matters. If you are appearing on a Special Election Part matter, the procedures are specific. Contact the Part Clerk in advance to confirm requirements.
- Follow Part rules strictly. The court will deny motions if the Part rules are not followed. Upload your proposed order to NYSCEF before the return date. If you are settling an order on notice, comply with the notification requirements for defaulting parties. Do not assume the court will overlook procedural shortcuts.
