What to Expect

Judge Sweeney is one of the more experienced jurists on the Kings County civil bench. He has seen it all. The courtroom runs efficiently, and the judge does not waste time on matters that are not ready. If you have a contested motion, be prepared to make your argument concisely and respond to questions on the law.

Tips

  • Be concise. Judge Sweeney appreciates attorneys who get to the point. If you can make your argument in five minutes, do not take fifteen.
  • Know the law. On contested motions, Judge Sweeney will engage on the legal issues. Be ready to cite authority and respond to the opposition papers.
  • Commercial contract cases are common. Part 73 handles a range of commercial contract disputes, including merchant cash advance and usury cases. If your motion involves receivable purchase agreements, be prepared to argue the loan-versus-purchase distinction and the specific factors the court will examine.
  • Experience matters here. This is a judge who will notice the difference between an attorney who knows the case and one who is reading from a script. Brief your per diem thoroughly.
