An In-Person Oral Argument Is Required for All Motions
The published Part Rules state it in their own capitalized line: an in-person oral argument is required for all motions. There is no submission practice in IAS Part 23. Someone has to stand up and argue the motion, in the courtroom, on the return date.
Return Dates and Conference Times
Motions are returnable, and cases are conferenced, on Monday or Tuesday at 9:00 a.m. Calendar the return date accordingly before you serve, and plan the morning around a 9:00 a.m. call rather than a later one.
Filing Deadline
Papers must be filed by 5:00 p.m. on the business day before the return date. That deadline lands the afternoon before a 9:00 a.m. appearance, so anything still being revised on the return date is already late.
Authority of Counsel Appearing
Counsel who appears must have knowledge of the facts and authority to stipulate or dispose. The requirement reaches whoever walks into the courtroom, not only the attorney of record.
Adjournments
Obtain the adversary's consent first. If consent is refused, contact chambers before the return date.

Before You Send a Covering Attorney
Two published requirements decide whether a covering attorney succeeds or fails in this part, and both are settled before the appearance date.
Every motion is argued in person. Nothing is submitted. Whoever appears has to argue the motion out loud, so an attorney who has not read the moving papers has nothing to say on the record.
Counsel appearing must have knowledge of the facts and authority to stipulate or dispose. That is the requirement that sinks a covering attorney who was sent in cold. Brief the covering attorney on the facts and confirm, in writing, what that attorney is authorized to agree to. The papers are due by 5:00 p.m. the business day before, and the call is at 9:00 a.m. on a Monday or a Tuesday, so the briefing has to happen the day before at the latest.

Field Note from September 8, 2026
On a Nassau County civil matter (Orgera v. Glen Coe Mansion, Index No. 607079/2026), the court was advised that the answer had been filed and issued a short-form order setting the matter down for a preliminary conference about four weeks out. The signed order is uploaded to NYSCEF after the conference, and the filed terms control. Read the NYSCEF version before you calendar anything off what was said in the courtroom.
