Tuesday Motion Calendar
“Motions assigned to Part 11, shall be made returnable and noticed to be heard before the Hon. Denise N. Johnson, Part 11 on Tuesdays at 10:00am.” A motion noticed for the wrong judge, day, time, part, or place may be marked off.
When an Appearance Is Required
“E-FILED CASES – NO APPEARANCE IS REQUIRED FOR MOTIONS NOT RELATED TO DISCOVERY, CONTEMPT, OR SEEKING UPFRONT RELIEF.” “NON-E-FILED CASES REQUIRE AN IN-PERSON APPEARANCE ON THE CALENDARED DATE.”
Discovery Motions Are Conferenced in Person
“Part 11 will conduct mandatory IN-PERSON conferences on ALL discovery-related motions on the day the matter is calendared to be heard.” A movant who misses the call has the motion marked off, and an opponent who misses it has the opposition marked off.
Adjournments
Motions may be adjourned on consent by a fully executed stipulation emailed to the part at least two business days before the calendar date. “Absent extenuating circumstances, consent adjournments shall be limited to one (1).”
Contacting the Part
“All questions regarding motions, orders to show cause, adjournments, calendar calls, and scheduling should be made via email at QSCPART11@nycourts.gov and NOT by calls to chambers.”
Always verify the current Part Rules with the Part before any appearance. The court publishes updates and assignment changes through nycourts.gov.
Before You Send a Covering Attorney
- Discovery, contempt, and upfront relief motions need someone at the call. Missing the call on a discovery motion marks off the motion or the opposition.
- Non-e-filed cases always require an in-person appearance.
- One consent adjournment, absent extenuating circumstances.
