Part 02 is a final calendar. Motions calendared here are listed for final determination, which means counsel must be prepared to argue the motion on the merits at the 9:30 AM call. In-person appearance is required. Appearances are held in Courtroom 314 at 88-11 Sutphin Boulevard, Jamaica. Telephonic and virtual appearances are not the default. If a virtual or telephonic appearance is needed for good cause, request it with the Part Clerk well in advance of the calendar date.

Be Present at Call

Because this is a final calendar, arriving late can result in the motion being marked submitted without oral argument, or in some cases, denied or dismissed for failure to appear. Plan security screening and courtroom navigation time accordingly. The Jamaica courthouse sees heavy morning traffic.

NYSCEF Filing

Motion papers should be e-filed through NYSCEF in accordance with CPLR and the court’s local filing rules. Working copies may be required for substantive or exhibit-heavy motions. Confirm working copy requirements with the Part Clerk when filing the motion.

Adjournments

Adjournment requests should be made on consent where possible and submitted to the Part Clerk in advance of the calendar date. Same-day adjournment requests on a final calendar are disfavored. If you need time, ask early.

The biggest adjustment for attorneys who practice primarily in motion submission parts is that Part 02 is a final calendar with live oral argument at 9:30 AM. The court expects counsel to have reviewed the papers, to be prepared to address the arguments, and to answer questions from the bench. Sending a per diem attorney who has not been briefed on the substantive issues will not serve the client well in this Part.

Practice Tips

  • Arrive early. Security and elevator lines at 88-11 Sutphin can eat 15 to 20 minutes at the 9:00 AM peak. Plan to be on site by 9:00 for a 9:30 calendar call.
  • Know your record. The judge expects counsel to know the motion record. Have specific page and exhibit references ready for key factual points.
  • Settlement discussions. Queens motion parts often ask whether settlement has been explored on personal injury matters. If discovery is still open, be ready to discuss the realistic trajectory of the case.
  • Courtroom changes. Queens Supreme Court reshuffled multiple Parts in January 2026. If you have not appeared in Part 02 recently, confirm the courtroom with the Part Clerk before arriving. A stale listing may send you to the wrong room.

When to Send Per Diem Counsel

Straightforward adjournments, procedural status updates, and uncontested applications are fine for experienced per diem coverage. Contested substantive motions, particularly dispositive motions, are better handled by the attorney of record or a fully briefed associate who has been involved in the underlying discovery record.
