Motion Calendar, Wednesdays at 9:30 AM in Courtroom 42
All motions are returnable and heard on Wednesdays at 9:30 AM in Courtroom 42 at 88-11 Sutphin Boulevard, Jamaica. The clerk calls the calendar at 9:30, and a second call follows shortly afterward. If the movant does not answer, the motion is marked off. If the opposing party does not answer, the motion is submitted on default. Motion appearances are in person.
Working Copies Are Mandatory
Motion papers are e-filed through NYSCEF, but the part also requires working hard copies of the motion papers and all exhibits, provided on the return date. Failure to produce them results in an adjournment. Copies sent to the part by email are discarded, so do not treat an email as a substitute.
Conferences
Part 02 does not hold preliminary conferences or compliance conferences. Conferences that the part does hold are generally conducted virtually over Microsoft Teams, and counsel requests a conference by email to the part address. Tort actions in this part are generally bifurcated.
Adjournments
A consent adjournment requires a fully executed stipulation or an affirmation emailed to the Part Clerk no later than two days, meaning 48 hours, before the return date, and the same document is e-filed. The part limits the parties to two consent adjournments. A request made later than the 48-hour cutoff may be denied unless it falls under 22 NYCRR 125.1, a medical emergency, another exigent circumstance, or the unavailability of the court.

Answer the Second Call or Lose the Motion
The whole calendar turns on the two calls. The clerk calls the list at 9:30, then calls it again a short time later. A movant who is not there on the second call has the motion marked off, and an opposing party who is not there has the motion submitted against it on default. Neither outcome requires any argument from the other side, so the attendance rule does more work in this part than the briefing does.
Practice Tips
- Bring the hard copies. The working copy requirement is not discretionary, and the part discards papers that arrive by email. An attorney who shows up with nothing on paper gets an adjournment instead of a decision.
- Arrive early. Security and elevator lines at 88-11 Sutphin can eat 15 to 20 minutes at the 9:00 AM peak. Plan to be on site by 9:00 for a 9:30 calendar call.
- Move the adjournment two days out. The stipulation has to reach the Part Clerk 48 hours before the return date, and the part allows only two consent adjournments, so counsel should not spend one casually.
- Do not look for a preliminary conference here. Part 02 does not hold preliminary or compliance conferences, and the conferences it does hold run virtually on request.
- Confirm the assignment. Queens reassigned a number of justices during 2026, and the published Queens rules PDFs lag the current bench. Call the Part Clerk to confirm the justice and the courtroom before you travel to Jamaica.

An earlier version of this page listed Courtroom 314 and described Part 02 as a final calendar with mandatory oral argument. The published Part 2 Rules place the part in Courtroom 42 and describe a Wednesday 9:30 AM motion calendar with a second call, not a final calendar. Both errors have been corrected against the published rules.
When to Send Per Diem Counsel
Straightforward adjournments, procedural status updates, and uncontested applications are fine for experienced per diem coverage. Contested substantive motions, particularly dispositive motions, are better handled by the attorney of record or a fully briefed associate who has been involved in the underlying discovery record.
