Discovery Conferences Are in Person
Discovery conferences are held in person at 60 Centre Street, Room 418. “Beginning on March 3, 2026, discovery conferences will be held on Tuesdays at 9:30 a.m.” Actions pending for over three years in which the note of issue deadline has passed may be scheduled for a status conference before Justice Kim on Thursday afternoon.
Proposed Orders After the Conference
“Proposed Preliminary Conference Orders or Compliance Conference Orders are to be submitted to the Assistant Law Clerk via email to dokim@nycourts.gov within forty-eight hours of the conference date.”
Defaults
For a scheduled conference, the rules state: “Should either party fail to appear at this conference, their default will result in an appropriate sanction, including the dismissal of the action pursuant to 22 NYCRR ยง202.27.”
Oral Argument
“Oral argument will be held in Room 418 on Wednesdays beginning at 9:30 am.” “The Court will notify the parties only if the application for oral argument is granted.”
Adjournments
Requests must be made at least 48 hours in advance, absent exigent circumstances, and must state the specific reason and the number of prior requests. A motion scheduled for argument may be adjourned up to 60 days from the original date without leave, on consent of all parties; any further adjournment requires a stipulation so ordered by the Court.
Other Requirements
Do not submit courtesy copies unless the Court requests them. Telephone calls to chambers are confined to urgent matters. “Chambers is not automatically notified when stipulations are filed on NYSCEF.”

Before You Send a Covering Attorney
The conference itself is only half the job in this part.
- Missing the conference can cost the case. The published sanction for a default includes dismissal.
- The proposed order goes to the Assistant Law Clerk within 48 hours of the conference. Make sure someone owns that task.
- Filing a stipulation on NYSCEF does not notify chambers.

Part 4 runs its discovery conferences in person on Tuesday mornings in Room 418.

Our office appeared for a plaintiff at a preliminary conference. The court issued a preliminary conference order assigning the case to the Standard DCM track, with 30-day deadlines for the BP and outstanding demands, depositions about four months out, and a note of issue deadline about eight months out. The next compliance conference was set for a Tuesday roughly five months later. The copy of the order taken at the part was not signed, so the order filed on NYSCEF controls. This is an account of one appearance on one date, not a published rule.
