Two Calendars, Not a Second Call
The TSP runs two pre-trial conference calendars Monday through Thursday, “called promptly at 9:30 a.m. and 11:00 a.m.” The rules warn that “the 11:00 a.m. calendar is not a second call of the 9:30 a.m. calendar.”
In Person, Familiar Counsel Only
“In-person appearances are mandatory at the call of each calendar.” “Only counsel fully familiar with the case and with authority to conference and/or settle the matter, shall appear at the Trial Scheduling Part calendars.” “Failure to appear may result in a case being dismissed or sent for inquest.”
Every Case Is Trial Ready
“Every case on the Trial Scheduling Pre-Trial Conference calendar is deemed ready for trial.” A case that does not settle at the conference gets “a firm date for trial (jury or non-jury).”
Adjourning a Trial Date
Requests go by email to QSCTRIALS@nycourts.gov, with all parties copied, at least ten business days before the trial date. “No adjournment requests will be considered if made by telephone.” A later request “shall be made in person at the call of the TSP calendar on the assigned trial date.”
Motions in Limine Only
“Only Motions in Limine are to be made returnable in TSP.” Justice Risi's Part 3 rules note that he sits in the TSP on Mondays and Tuesdays and that Part 3 chambers does not handle TSP adjournment requests.
Always verify the current Part Rules with the Part before any appearance. The court publishes updates and assignment changes through nycourts.gov.
Before You Send a Covering Attorney
- Counsel must be fully familiar with the case and have authority to settle. The rules say so in terms, so brief the covering attorney on the file, the bill of particulars, and prior orders.
- Be there for your calendar. The 11:00 a.m. calendar is a separate calendar, not a second call, and a missed call can mean dismissal or inquest.
- Expect a trial date. A case that does not settle leaves with a firm trial date.

What to Expect
The Trial Scheduling Part is a settlement and scheduling part for cases that are ready for trial, so the attorney who appears should know the settlement posture and the client's authority.
Field Note: November 2, 2026
On November 2, 2026, our office appeared for a defendant at a status conference in the Trial Scheduling Part. The court removed the action from the Supreme Court to the Civil Court under CPLR 325, so the case went no further in this part. That is an account of a specific appearance, not a published rule.
