Motions Are Decided on Submission
This is a submission part. Motions are decided on the papers. An appearance is not required on the return date unless the Court directs an appearance, or unless oral argument was requested in writing and the request was granted. Sending an attorney to argue a motion that the Court intends to decide on submission is a wasted trip to Goshen.

At a status conference in Cruz v. HV Property Maintenance (Index No. EF010097-2025), the Court set a single date certain covering two outstanding items, responses to supplemental demands and a records authorization, and directed that the independent medical examination be noticed by that same date. The next conference was set for December 8, 2026 at 10:00 a.m., in person.
The practical point for a covering attorney is that the part consolidated the outstanding discovery onto one deadline rather than staggering it, and tied the independent medical examination to that deadline as well. Come to a conference in this part able to state the status of every open item and a date the client can meet.
