Calendar and Promptness
“The Court's calendar will be called at 9:30 a.m. daily, unless otherwise specified by the Court.” “Unexcused late arrivals will not be tolerated.” Where counsel has a conflicting appearance, the Court may proceed in that counsel's absence.
Who Appears
“Appearances are required by counsel (or self-represented parties) who are fully familiar with a case and authorized to enter into binding agreements on all aspects of the case.”
Conferences
The Court schedules a preliminary conference within 45 days after an RJI is filed, and at that conference sets final dates for discovery, the date by which all disclosure must be completed, and a compliance conference date. Where a party is indemnified by an insurer, counsel at a settlement conference must be able to state the policy limits and the name, claim number, and phone number of the assigned adjuster. A trial binder is due at least five business days before the pre-trial conference.
Motions
“All motions will be taken on submission unless oral argument is directed by the Court or specifically requested by a party.” To request argument, write “Oral Argument Requested” above the index number on the first page. Motions may be made returnable on any day the Court is in session. Working copies are not required.
Adjournments
Applications are made in writing through NYSCEF at least 48 hours in advance and must state the reason, whether the other parties consent, the length sought or the agreed date, and the number of prior requests. “A request for an adjournment, even if on consent of all parties, is NOT effective unless and until approved by the Court.”
Communications
Scheduling inquiries go to the Part Clerk. Telephone calls to chambers are permitted only for matters needing immediate attention that cannot be handled by correspondence or through the Part Clerk. Opposing counsel must be told at least 24 hours in advance before an order to show cause with a TRO is presented, absent significant prejudice.

- Be in Courtroom 4 at 9:30 a.m. Late arrivals are not tolerated, and the Court may proceed without counsel.
- At a settlement conference with an insured defendant, have the policy limits and the adjuster's name, claim number, and phone number.
- A consent adjournment is not effective until the Court approves it.

Our office appeared for a defendant at a preliminary conference. The Court set the full schedule at the conference: insurance disclosure within two weeks, the BP and any further demands within about five weeks, responses within about two months, party depositions within about four months, nonparty depositions two weeks after that, and a note of issue deadline about six months out. A compliance conference was set for 9:30 a.m. about three and a half months later, and the Court was to upload a signed order to NYSCEF. This is an account of one appearance on one date, not a published rule.
