A Monday Motion Calendar in Person
“Effective April 13, 2026, all motions shall be returnable and heard in-person on Mondays at 10:00 am at 88-11 Sutphin Blvd., Jamaica, NY 11435, Courtroom 313.” “A second call will begin promptly at 10:30 am.” The Teams link is for emergencies only, with prior judicial approval.
Appearances Are Mandatory and Motions Are Argued
“In-Person Appearances are mandatory for ALL motions and applications.” Missing the return date may get the motion marked off. “ALL fully submitted motions will be conferenced/orally argued following the call of the calendar.”
Who May Appear at a Conference
“Counsel appearing for these conferences (and any conference with the court) MUST be fully familiar with the matter in dispute and must have authority to bind their clients at conference.”
Adjournments
Motions may be adjourned on consent by a fully executed stipulation emailed to QSCPart21@nycourts.gov no later than two business days before the calendar, and consent adjournments are limited to two. Any further request goes by email and is subject to the Judge's approval.
CSCP2 Is a Separate, Virtual Part
Compliance conferences in CSCP2 are held virtually on Wednesdays and Thursdays. The rules stress that “CSCP2 and Part 21 are separate and distinct parts and should be treated accordingly.”
Always verify the current Part Rules with the Part before any appearance. The court publishes updates and assignment changes through nycourts.gov.
Before You Send a Covering Attorney
- Every motion and order to show cause requires an in-person appearance. Nothing in Part 21 is on submission.
- Every fully submitted motion is conferenced or argued after the calendar call. Send someone who knows the papers.
- Counsel at any conference must be fully familiar with the matter and able to bind the client.

What to Expect
Justice Schiff hears every fully submitted motion after the call, so a Monday in Part 21 is an argued calendar, not a check-in.
Field Note: October 29, 2026
On October 29, 2026, our office appeared for defendants on an order to show cause seeking a temporary restraining order to stay a foreclosure auction set for the next day. The plaintiff opposed and would not consent to postponing the sale. Justice Schiff heard both sides, said he would review the papers on the sale, and reserved decision, and no decision had issued when our office left at 1:00 p.m. That is an account of a specific appearance, not a published rule.
