What to Expect

Justice Socorro sits in IA Part 33, the City and Transit part, and the published rules apply only to Part 33 inventory involving the City of New York and the New York City Transit Authority. The rules state that all appearances are in person unless the Court directs otherwise. The calendar is called at 10:00 a.m. and the Court takes a default at 11:30 a.m. Compliance and status conferences run on a fixed weekly schedule, with Transit cases on Mondays and City and NYPD cases on Tuesdays. Motions, orders to show cause, and summary judgment motions are all noticed for Thursdays at 10:00 a.m. and require an in-person appearance. Oral argument is not automatic. Where the Court grants argument, or where a summary judgment motion is fully briefed when it is called, the Court schedules a separate virtual conference over Microsoft Teams.

Tips

• Thursday is the motion day and the appearance is in person. Every motion and order to show cause is returnable Thursday at 10:00 a.m. in Courtroom 708. Motions are noticed to Part IA-33 but are calendared for Room 217. A movant who does not appear on an order to show cause risks denial for non-appearance.
• Recording is prohibited. Photography and audio or video recording are barred in the courtroom, and recording a virtual proceeding is expressly prohibited. Do not plan to capture argument.
• Discovery motions are disfavored, and you must bring paper. The Court expects good-faith efforts under 22 NYCRR 202.20-f, and a discovery motion must carry an affirmation reciting the date, participants, and length of the meet-and-confer conference. Counsel must bring copies of the discovery motion and the responsive papers to court on the return date.
• Summary judgment within 90 days of the Note of Issue. Part 33 sets 90 days, not the CPLR default. The Court does not require a Statement of Facts under 22 NYCRR 202.8-g, and successive summary judgment motions require newly discovered evidence or other sufficient justification.
• A represented plaintiff does not appear for the preliminary conference. Where plaintiff has counsel, no appearance is required and the Court issues a Case Scheduling Order automatically on the preliminary conference date, then uploads it to NYSCEF. A self-represented plaintiff does appear in person.
• Adjournments are tightly capped. A stipulation to adjourn must be filed on NYSCEF and emailed to the part at least 48 hours before the scheduled date, must set the full briefing schedule, and must be so-ordered. No motion is adjourned more than 60 days or more than three times, and the adjourned date must be a Thursday.
• Format traps that draw a denial. Deposition transcripts must be filed as full-page transcripts, not the condensed version, and any exhibit other than a pleading that runs more than 10 pages must have the relevant sections highlighted and referenced in the affirmation.
• A per diem can cover the virtual sur-reply conference. The rules expressly contemplate a firm sending another attorney or a per diem to the Microsoft Teams conference when counsel has a conflict, and they place the burden of forwarding the Teams invitation on the attorney who cannot appear.

Justice Socorro's IA-33 motion calendar continues to carry a high volume of cases against the New York City Transit Authority, the New York City Department of Education, and the City of New York. Counsel covering should know the standard municipal defense playbook: 50-h status, GML notice of claim sufficiency, late notice motions, and the timing of municipal answers.
• Active Thursday motion calendar. The Thursday calendar carries a substantial volume of motions filed by small and mid size plaintiff firms. Cover for these calendars should be booked several days in advance: same-day coverage in this Part is not reliable.
