Status Conferences Are the Note of Issue Date

Status conferences are held in person on Mondays at 10:00 a.m., and all parties must appear. “Your status conference date is also your Note of Issue date.” If discovery is outstanding, appear and enter into a new status conference order, which sets a new status conference and note of issue date. “DO NOT MAKE A MOTION TO EXTEND YOUR NOI DATE.” If the note of issue has been filed, or the case has settled, there is no need to appear.

Compliance Conferences

Compliance conferences are held in person on Tuesdays at 10:00 a.m., and all parties must appear. Failure to appear may result in the case being marked off the calendar. The attending attorney must be familiar with the matter, prepared to discuss discovery outstanding since the Case Scheduling Order, and prepared to enter into a stipulation. Preclusion language will not be granted at a conference without a motion. The part is not holding virtual discovery conferences.

Preliminary Conferences

“Post-2020, there are no in-person preliminary conferences (unless there is a self-represented party).” A Case Scheduling Order is issued automatically on the preliminary conference date and uploaded to NYSCEF.

Discovery Motions and Orders to Show Cause

Discovery motions are automatically adjourned to the in-person Discovery Motion Calendar on Thursday at 10:00 a.m., and the parties must bring copies of all discovery motion papers to court. Orders to show cause are scheduled for Thursdays at 10:00 a.m., in person, and no reply is permitted without the Court's express permission.

Adjournments

Discovery and dispositive motions are subject to the 60-day adjournment rule. An adjournment on consent is made by a written stipulation signed by all appearing parties, submitted to NYSCEF before the return date, and emailed to chambers at calcaraz@nycourts.gov. Adjournment requests for discovery conferences go to the Part Clerk.

Communicating With Chambers

“Do not call chambers regarding scheduling matters.” Support staff may not contact chambers; the attorney assigned to the matter asks the questions. Do not copy the Justice, the law clerk, or the Part Clerk on emails between the parties about discovery unless the Court asks.

Always verify the current Part Rules with the Part before any appearance. The court publishes updates and assignment changes through nycourts.gov.

Before You Send a Covering Attorney

Every conference in this part is in person, and the status conference carries the note of issue deadline with it.

  • A status conference with discovery outstanding requires an appearance and a new status conference order. Do not move to extend the note of issue date.
  • A missed conference can be marked off.
  • Bring paper copies of discovery motion papers to the Thursday calendar.

Part IA-3 conferences its cases with the City, and the rules ask the parties to seek the Court's intervention only as a last resort.

Field Note: September 14, 2026

Our office appeared in person for a plaintiff at a 10:00 a.m. Monday status conference. A stipulation was so ordered at the conference, and the next status conference, also the new note of issue date, was set about nine months out. That matches the published rule that the status conference date and the note of issue date are the same. This is an account of one appearance on one date, not a published rule.
