What to Expect

Part IA-11 is a conference-heavy part. Judge Nicolas-Brewster handles a significant volume of preliminary and compliance conferences, and the courtroom is focused on moving cases through discovery. If you are appearing on a conference, the single most important thing is knowing the discovery status of your case.

Tips

  • Discovery status is everything. At every conference, be prepared to report on exactly where discovery stands. What has been exchanged? What depositions are scheduled? What is outstanding and why?
  • Use the correct PC order form. There are separate forms for non-Labor and Labor Law matters. Download and complete the correct form from nycourts.gov before appearing.
  • Compliance conferences are not formalities. If discovery is stalled, be prepared to explain why and commit to specific deadlines. Do not ask for an open-ended adjournment.
