Motion Days in Person
“All motion will be heard in-person, on Tuesday’s for FRP 3 Foreclosure motions and on Wednesday’s for Part 27 Motions in Courtroom 359, unless the Court indicates otherwise.”
Two Calendar Calls
“There are two calendar calls; the first call is at 9:30 AM and second call is at 10:30 AM.” The rules add: “Do NOT call the Court to inquire as to whether an appearance is required!”
No Submissions
“All motions require an in-person appearance; no motions are taken on submission WITHOUT oral arguments.” The only exception is a motion resolved in advance by a fully executed stipulation on NYSCEF, confirmed with the part clerk.
Adjournments
“DO NOT CALL THE COURT FOR ADJOURNMENT REQUESTS!” Advance requests need a signed consent order uploaded to NYSCEF at least 24 hours ahead. An emergency request “can be made in-person by a person from your law firm or your adversary AT THE CALENDAR CALL.”
Courtesy Copies and the Short Form Order
Every attorney must bring one printed courtesy copy of their own papers. After argument the parties submit a short form order, and “Failure to submit a proposed short form order by 3 PM on the date of argument, will result in the motion being marked off calendar.”
Discovery
“This Court will not make discovery rulings as all discovery matters are handled in the Central Compliance Part.”
Always verify the current Part Rules with the Part before any appearance. The court publishes updates and assignment changes through nycourts.gov.
