Per Diem Counsel Are Welcome

“Per diem covering counsel are welcome in this Part.” Every attorney appearing must have complete knowledge of the facts and full authority to enter into agreements, and attorneys at conferences must have telephone access to their clients, claims adjusters, or persons with authority to settle.

Conferences in Person

“Unless otherwise directed, all conferences shall be held IN PERSON, Monday through Wednesday, from 9:30 a.m. to 12:00 p.m.” Cases are called first come, first served once all sides are present.

A Discovery Stipulation Instead of Appearing

Unless a discovery motion is pending, the parties may skip a conference by e-filing and emailing a proposed discovery stipulation by 3:00 p.m. on the business day before. “Counsel and pro se (self-represented) litigant(s) unable to stipulate to any discovery issues or dates must appear in-person as scheduled.”

Motions

“Unless otherwise directed, motions, including Orders to Show Cause, will be decided on SUBMISSIONS ONLY.” “Oral arguments may be requested only by the moving party.” Discovery motions may not be filed until the issues have been conferenced with the Court.

Adjournments

Requests use the part's Request for Adjournment Form, emailed to the part, and must be received by 3:00 p.m. on the business day before. Requests left on chambers voicemail are disregarded.

Always verify the current Part Rules with the Part before any appearance. The court publishes updates and assignment changes through nycourts.gov.

Before You Send a Covering Attorney

  • Per diem covering counsel are welcome, but must know the facts and have authority.
  • Have the client or adjuster reachable by phone. The rules require it at conferences.
  • Conferences are in person unless the parties stipulate in advance.

Practitioner Intelligence

Observations from our office's appearances, kept separate from the published rules above. Last reviewed: November 2, 2026.

What to Expect

Justice Kapoor reads service provisions closely. An order to show cause that directs a method of service needs an affirmation of service that says how service was made.

Field Note: October 26, 2026

On October 26, 2026, our office appeared for defendants on their counsel's order to show cause to be relieved. The plaintiff did not oppose, but Justice Kapoor denied the application for improper service: the affirmation of service did not state how service was made, and the order to show cause had required service by overnight mail. The court cautioned that service provisions are not to be taken lightly and said the application may be renewed. That is an account of a specific appearance, not a published rule.
