Conferences
“All conferences with the Court are conducted promptly at 9:15 a.m., in person, Monday through Friday.” Preliminary conferences are held in the Preliminary Conference Part, and preliminary conference adjournments go to the DCM Clerk's office or the Preliminary Conference Part at (516) 493-3120. A certification conference is held no later than 90 days before the note of issue deadline, and no note of issue may be filed without the Court's permission.
Per Diem Covering Counsel
“Counsel, including per diem covering counsel and pro se (self-represented) litigant(s), must appear on time, be fully familiar with the action(s)” and be prepared and authorized to act for the client. Counsel must also be authorized to enter into binding settlements.
Motions and Orders to Show Cause
“There will be no oral argument required on any motion unless directed by the Court.” But “All Orders to Show Cause will require an in-person appearance with oral argument unless otherwise directed by the Court.” Working copies are not required unless requested.
Adjournments
A request to adjourn a conference is made in writing, uploaded to NYSCEF and copied to chambers by email, at least 24 hours in advance. “Parties should not assume that any stipulated request for adjournment of a conference has been granted unless specifically advised by the Court.” Motion adjournments may only be granted by the Court, not by stipulation.
Telephone Calls
Telephone calls to court staff are permitted only in urgent situations requiring immediate attention.

Before You Send a Covering Attorney
Arrive earlier than you would for most Nassau parts.
- Conferences start promptly at 9:15 a.m.
- An order to show cause means an in-person appearance and argument.
- A stipulated adjournment is not granted until the Court says so.

Our office appeared for plaintiffs at a status conference, and Justice McGrath conferenced the matter with all counsel. The Court moved the plaintiff's deposition earlier, directed the plaintiffs to designate a hospital witness by the next day for a deposition about three weeks out, directed Medicare and Medicaid authorizations, and directed defense counsel to determine whether the hospital employed a named nurse on the date of the incident. The directives were to be reduced to an order, and a compliance conference was set two weeks later at 9:15 a.m. This is an account of one appearance on one date, not a published rule.
