Published Part Rules

Appearances Are in Person

“ALL COURT APPEARANCES IN PART 8 ARE HELD IN-PERSON.” The exception is the preliminary conference: “the parties do not need to appear in person for any scheduled Preliminary Conference,” because the Court issues a scheduling order.

Who May Appear

“In compliance with 22 NYCRR 202.1(f), counsels who appear before the Court must be familiar with the case, be fully prepared and authorized to discuss and resolve the issues which are scheduled to be the subject of the appearance.”

Calendar Call

“THE FINAL CALENDAR CALL FOR ALL MORNING SCHEDULED MATTERS IS 10:30AM.” “Failure to appear at the second call of the calendar may result in dismissal or default per 22 NYCRR 202.27.”

Compliance Conferences

If the parties agree on outstanding discovery, they may e-file and email a fully executed stipulation, and if it is acceptable, no appearance is needed.

Motions

“All motions will be decided “on submission” unless the Court notifies the parties that the matter has been scheduled for oral argument/conference before the Court.” Discovery motions require the Court's permission.

Settlement Conferences

“Anyone appearing at a settlement conference is expected to be fully familiar with the file, have full authority to resolve the case, and/or immediate access to their client to obtain such authority.”

Always verify the current Part Rules with the Part before any appearance. The court publishes updates and assignment changes through nycourts.gov.

Before You Send a Covering Attorney

  • Every appearance is in person.
  • The final morning call is 10:30 a.m. Missing it risks dismissal or default.
  • Counsel must be familiar with the case and authorized to resolve the issues on for that day.

What to Expect

Status conferences in Part IA-8 are often handled with the court attorney, who will adjourn a conference to allow a planned motion to be made when counsel explains the plan.

Field Note: October 22, 2026

On October 22, 2026, our office appeared at a status conference and advised the court attorney, as the referring firm directed, that a motion to renew a default motion would be made. The conference was adjourned about seven weeks to allow time for the motion, and no order issued. That is an account of a specific appearance, not a published rule.
