Appearance Time and Default
“Litigants must appear in court at 9:30 a.m. for their case, unless otherwise specified by the Court.” “The failure to appear by 10:00 a.m. may result in a default.” An attorney who must check in with another part must leave contact information and return by the second calendar call.
Status and Compliance Conferences
If the parties agree on all outstanding discovery, they e-file and email a fully executed stipulation to BxSupCiv-IA26@nycourts.gov. If they cannot agree, they e-file and email a request for a compliance conference. If discovery is complete, they e-file and email a stipulation certifying that all discovery is complete. For a preliminary conference, all parties fill out the preliminary conference form and submit it on the return date.
Motions
“All motions will be decided ‘on submission’ unless the Court notifies the parties that the matter has been scheduled for oral argument.” Oral argument is held on Thursdays at 9:30 a.m. A party may request argument by a letter accompanying the motion papers, also sent by email to the part. Discovery motions are highly discouraged, require the Court's permission to file, and require oral argument. Do not send courtesy copies.
Adjournments
“No more than three stipulated adjournments, for a period of 60 days each, for a total of 180 days, shall be submitted without prior permission of the Court.” Whatever date the stipulation proposes, the Court adjourns motions only 60 days at a time.
Settlement Conferences
“Part 26 conducts its settlement conferences in person.” Anyone appearing must be fully familiar with the file and have full authority to resolve the case, or immediate access to the client to obtain it.

Field Note: September 16, 2026
Our office appeared in person for a defendant at a 9:30 a.m. status conference. A co-defendant had exchanged a video after the plaintiff was already partly deposed, and plaintiff's counsel objected to the timing. The court adjourned the conference about eleven weeks so that the plaintiff could move for relief, and no stipulation was entered. This is an account of one appearance on one date, not a published rule.
