In Person, With Authority

“Unless otherwise directed by the Court, attorneys shall appear in person at the time indicated for all conferences.” “All attorneys appearing for a conference shall be knowledgeable and familiar with the case and shall be vested with the authority to enter into stipulations and/or dispositions which bind their respective clients.”

Attorneys of Record

The rules provide: “Attorneys who have appeared in the matter are to make all appearances until they are relieved by the Court or until a Consent to Change Attorney has been filed in NYSCEF and with this part by email or fax.”

Counsel must alert the courtroom clerk and complete a sign-in sheet, and an attorney due in another part must tell the Part Clerk where they will be and how to reach them.

Conference Adjournments

Preliminary conference adjournments go to the DCM Part. Other conference adjournments go through chambers on the Request for Adjournment Form, with consent and two proposed dates within six weeks. “Adjournment requests that are left on Chamber’s voicemail shall be disregarded.”

Motions on Submission

“Counsel are not required to appear on the return date of the motion unless directed by the Court or unless there is a contested application for adjournment.” If the other side will not consent to adjourn a motion, all counsel must appear in person on the motion date.

Always verify the current Part Rules with the Part before any appearance. The court publishes updates and assignment changes through nycourts.gov.

Before You Send a Covering Attorney

  • Read the attorneys of record rule before you send anyone. The rules expect the attorneys who have appeared in the matter to make the appearances, so confirm with the part that covering counsel is acceptable on your case.
  • Conferences are in person, and counsel must be able to bind the client.
  • Sign in with the courtroom clerk.

Practitioner Intelligence

Observations from our office's appearances, kept separate from the published rules above. Last reviewed: November 2, 2026.

What to Expect

Conferences in Part 18 are in person, and the part keeps a sign-in sheet, so the covering attorney should check in as soon as they arrive.

Field Note: October 28, 2026

On October 28, 2026, our office appeared in person for a plaintiff at a post-mediation status conference. No one appeared for the defendant. The part telephoned defense counsel's office, which said it understood the conference to be adjourned because the mediation had been adjourned, and the court adjourned the conference to a date after the further mediation session, about six weeks out. That is an account of a specific appearance, not a published rule.
