In-Person Appearances at 9:30 AM

All conferences and motion appearances before Justice Sher are scheduled at 9:30 AM in person, except on Tuesdays, when they begin at 9:00 AM, unless Chambers directs otherwise. Defaults in appearance will not be taken on the record until at least 15 minutes after the scheduled conference time, so being a few minutes behind security is not automatically fatal, but plan to be on time and checked in.

Check-In Procedure

Attorneys and pro se litigants must check in with the Court Officer or Part Clerk, if one is available. If the courtroom is unavailable, counsel must call Chambers from the Fourth Floor Security Desk, and only when all parties are present. Do not call Chambers ahead of the other side arriving.

Motion Papers

All papers must be submitted timely on the date the motion is heard. The Court will not consider late papers absent prior Court approval. No sur-reply affidavit, affirmation, memorandum of law, or letter will be accepted or considered without leave of the Court. Keep the record clean and complete before the return date.

Adjournments

Adjournment requests may be granted by Chambers if the request is on the consent of all parties. For a consent adjournment, counsel may email or fax a letter to Chambers, copied to all counsel, indicating the case name, Index No., motion sequence number(s), the original return date, and the mutually agreed adjourned date. A fully executed stipulation is not required for a consent adjournment.

Part 24 Is an In-Person Part. Show Up.

Justice Sher hears conferences and motions in person. This is not a submission-only part where the papers carry the day without an appearance. If your matter is on the Part 24 calendar, someone needs to be there, checked in, and ready. Nassau attorneys who cannot make the Mineola trip regularly use per diem coverage for exactly this kind of appearance.

Practice Tips

  • Watch the Tuesday time. The default call is 9:30 AM, but Tuesdays start at 9:00 AM. Confirm the day and time before you arrange coverage so no one shows up half an hour late.
  • Fifteen-minute grace. Defaults are not entered until at least 15 minutes after the scheduled time. Useful to know, but not something to rely on. Be on time.
  • All parties present before calling Chambers. If the courtroom is unavailable, the Fourth Floor Security Desk call to Chambers happens only once everyone is there.
  • No late papers, no sur-replies. Sher enforces the paper rules. Get everything in on time and do not try to slip in a sur-reply without leave.

When to Send Per Diem Counsel

Consent adjournments, preliminary and compliance conferences, and routine motion appearances are well suited to experienced per diem coverage. Contested substantive motions, particularly dispositive motions, are better handled by the attorney of record or a fully briefed associate who knows the record.
