Per Diem Counsel

The rules require all counsel, including per diem counsel, to appear on time, be fully familiar with the action, be prepared to discuss all factual and legal issues, know the settlement demands and offers, and be authorized to enter into agreements for the client. They also state: “Per Diem counsel are not permitted at ADR/Settlement conferences.” At the first compliance conference, in addition to the status of discovery, the Court will address alternative dispute resolution.

Conferences

“All conferences with the Court are conducted promptly at 9:30am, in person, unless otherwise directed.” Preliminary conferences are held in the Preliminary Conference Part. A certification conference is held no later than 90 days before the note of issue deadline, and no note of issue may be filed without the Court's permission.

Motions

“There will be no oral argument required on any motion or Order to Show Cause unless directed by the Court.” To request argument, write “Oral Argument Requested” on the papers. Counsel are not required to appear on the submission date unless directed. Failure to appear at a motion conference may result in denial of the non-appearing party's motion or a grant on default.

Adjournments

A request to adjourn a conference is made in writing, uploaded to NYSCEF and copied to chambers by email, at least 24 hours in advance. “Adjournment requests that are left on Chambers's voicemail shall be disregarded.” Motion adjournments “may only be granted by the Court, not by stipulation of counsel.”

Other Requirements

Opposing counsel must be told at least 24 hours in advance before an order to show cause with a TRO is presented, absent a true emergency. Telephone calls to court staff are permitted only in urgent situations.

Before You Send a Covering Attorney

This is one of the few parts whose own rules limit what a per diem attorney may do.

  • Per diem counsel may not appear at an ADR or settlement conference. Send the attorney of record.
  • The first compliance conference also addresses ADR. Confirm with the referring firm what that conference will involve before assigning it.
  • Conferences start promptly at 9:30 a.m. and are in person.

Our office appeared for a plaintiff at a status conference, which was conferenced with chambers staff rather than the Justice. The parties had executed a stipulation to consolidate, and another party's counsel was to email it to the Court to be so ordered. The Court directed that depositions be completed within about seven weeks and set a compliance conference for the same date. This is an account of one appearance on one date, not a published rule.
