Tuesday Motion Calendar
“The Part 5 motion calendar is held on Tuesdays at 10:00 a.m. and 11:30 a.m., as designated on eCourts.” Appearing counsel must check in with the Court Officer or Part Clerk, and “any party not present when the case is called may be marked in default.”
Contested Motions Are Argued
Contested motions, other than motions to renew or reargue and certain discovery disputes, “will be scheduled for oral argument.”
Discovery Conferences Run Through DCM
“Discovery conferences for cases in the City Part are scheduled by the Differentiated Case Management Part (“DCM”), not by the individual assignment parts.” Before a discovery motion, the parties must meet and confer and then email the Part Clerk to request a conference.
Adjournments
“DO NOT CALL CHAMBERS OR THE PART REGARDING ADJOURNMENTS.” Requests must be made at least two business days ahead, filed on NYSCEF and emailed to the Part Clerk with a stipulation stating the reason or an affirmation detailing the efforts to obtain consent.
Summary Judgment Timing
“All motions for summary judgment shall be made no more than 120 days after the filing of the note of issue.”
Always verify the current Part Rules with the Part before any appearance. The court publishes updates and assignment changes through nycourts.gov.

What to Expect
Discovery conferences on Justice Marcus's City cases are held in person in the DCM Part at 80 Centre Street, and the schedule usually ends up in a handwritten stipulation so-ordered at the part.
Field Notes: August to October 2026
Between August and October 2026, our office appeared at preliminary and compliance conferences on City cases assigned to Justice Marcus, held in person in the DCM Part at 80 Centre Street. At a preliminary conference the court signed a Case Scheduling Order for City cases that supersedes all prior demands and discovery orders. At compliance conferences counsel resolved open items on consent, and the court so-ordered a handwritten stipulation at the part. Twice the year written for the next conference date on a handwritten stipulation was unclear, so check the date against the order as filed on NYSCEF. Those are accounts of specific appearances, not published rules.
