Preliminary Conferences
Preliminary conferences are handled through the Preliminary Conference Part, and an application to adjourn a preliminary conference is addressed to that part rather than to Part 20. The preliminary conference order sets the discovery, certification, and Note of Issue deadlines. An application to adjourn a scheduled deposition is made to chambers.
All Other Conferences
Unless the attorneys or self-represented parties are specifically advised otherwise by chambers, all appearances are in person.
Motions
Counsel are not required to appear on the return date of a motion unless the court directs an appearance or there is a contested application to adjourn. Oral argument is generally not entertained. A motion adjournment is arranged through the Courtroom Clerk or on the part’s Request for Adjournment Form.
Discovery Motions Require a Pre-Motion Conference
A discovery motion may not be filed until counsel requests a pre-motion discovery conference using the part’s Pre-Motion Discovery Conference Request Form. The Part Rules state that letters exchanged between counsel, standing alone, do not satisfy the good-faith effort requirement.

- Never fax and never email the judge. Faxes are not accepted for any purpose, and written communication goes to the chambers email address, not to the justice.
- Track your discovery timeline. Stay on top of the deadlines in the preliminary conference order. If your case has been dormant because of counsel changes or motion practice, come prepared to explain the status and propose a schedule.
