Part and Courtroom

Conferences
All conferences before Part 43 are held in person at 9:30 AM. Preliminary conferences are not held in Part 43. They are held in the Preliminary Conference Part only.
Motions Are on Submission
All motions, cross-motions, petitions, and Orders to Show Cause are decided on submission. No appearance is necessary on the return date unless the court directs otherwise. Counsel who calendar an appearance on a return date in this part are appearing for nothing.
Correspondence
All correspondence with the part must be emailed to JudgeRizzoRemote@nycourts.gov and uploaded to NYSCEF as a letter. Letters are limited to three pages and must be submitted by 3:00 PM on the day before the appearance or return date. Chambers is reachable by telephone for emergencies only.
Adjournments
An adjournment request must be made by letter uploaded to NYSCEF and emailed to the part by 3:00 PM on the day preceding the scheduled date. Only the court may grant an adjournment, so a consent stipulation between counsel does not move the date on its own.
NYSCEF Filing
Nassau County Supreme Court requires NYSCEF filing for most civil matters, including motions and Orders to Show Cause. All applications and supporting affirmations should be filed through NYSCEF before submission.

What to Expect
Justice Rizzo now sits in IAS Part 43, a general civil IAS part in Courtroom 313. Earlier versions of this page described a foreclosure settlement conference calendar in Room 03 on the lower level. That is no longer where this judge sits, and the current Part 43 Rules say nothing about foreclosure settlement conferences.
Tips for Success
- Do not book an appearance on a motion return date. Everything in this part is on submission unless the court says otherwise, so a per diem appearance on a return date is wasted money.
- Conferences are the appearance that matters. They are in person at 9:30 AM in Courtroom 313. Arrive with the discovery status and dates you can commit to.
- Preliminary conferences go elsewhere. Nassau holds PCs in the Preliminary Conference Part, and a PC is required in Nassau, so do not calendar it for Part 43.
- Everything in writing, by 3:00 PM the day before. Letters and adjournment requests go to NYSCEF and to the part email, capped at three pages. A late request is no request.
- Only the court adjourns. A stipulation between counsel is a proposal. Do not tell your client the date moved until the part confirms it.
